Tolman High Police Officer Boudreault Already Subject of Federal Lawsuit
Pawtucket Police Officer Jared Boudreault, the Policeman involved in the now viral "Tolman Take Down", is already a defendant in a Federal Lawsuit. In Miner v. Valade et al, Officer Boudreault is alleged to have participated in the illegal arrest, and subsequent imprisonment of Pawtucket resident John Miner. Miner, a Founding Member of Community Response Rhode Island, was carrying a legally purchased, holstered weapon, outside his home. A vocal dispute, of which Mr. Miner was merely an observer, led to the arrival of the Pawtucket Police, including Officer Boudreault. Upon the realization that Mr. Miner was armed, the officers grabbed him, and he voluntarily surrendered his firearm. Mr. Miner, in possession of a "Blue Card", was detained, processed, and jailed without formal charges ever being waged. Rhode Island Law allows for "Blue Card" carriers to own, and carry legally purchased firearms in their home and property. District Court Judge John McConnell, in dismissing claims for summary judgement, has allowed the case to proceed to jury trial, citing the Police Officer's clear ignorance of Rhode Island Law.

"(Defense Atty) DeSisto said the plaintiffs must show that the officers were "plainly incompetent" or knowingly violated the law. He contends that attorneys should show one of those and the fact that Miner's statutory rights were violated for a successful suit.(Justice) McConnell asked DeSisto how "a lack of knowledge of a very clear law" was anything but "plainly incompetent" behavior on the part of the police."
